Samsung Galaxy Nexus Ban Overturned: Blow to Apple in U.S. Appeals Court Ruling Here

The U.S. Court of Appeals now has overturned an injunction banning sales of the Samsung Galaxy Nexus smartphone. The Samsung Galaxy Nexus ban, issued in June by a California district court, was an unlawful “abuse” of the court’s discretion, the ruling says. Read it below the fold.

Meanwhile, Apple co-founder Steve Wozniak is telling reporters that Apple has gotten “arrogant” so far as its design strategies go.

Last week, a court also lifted a ban on Samsung’s Galaxy Tab 10.1 computer. That is also related to the Apple vs. Samsung case.

In August 2012 Samsung lost big time to Apple in the high-profile Apple IP suit. A jury awarded Apple half of what it asked for — it still amounted to some $1 billion — but it didn’t side with Samsung on a single issue. The case  involves just seven patents — mostly design patents — and it’s just the beginning of the Apple vs. Samsung patent war.

The late Apple CEO and co-founder Steve Jobs, in his biography, said he felt ripped off and would fight Google Android tech to the end. That includes smartphones and tablets such as Samsung’s. The Apple vs. Samsung battle is a high-profile case — and a complicated one.

Samsung manufactures more than a quarter of the parts in the Apple iPad and Apple iPhone. Samsung also competes with Apple via its Android-based smartphones and tablets.

As we’ve reported, Samsung already has demanded a retrial based on issues including jury misconduct. Foreman Vel Hogan turned out to be an inventor who might have led jurors, Samsung reps say. This is a big blow to Apple today in its ongoing patent war with Samsung. We’ve reached out to Apple and Samsung for original comment.
